Acceptance and Agreement to Terms
By accessing, browsing, or otherwise using the website, platform, and subscription services provided by Workspace Global (referred to herein as "the Service"), you ("the Client," "User," or "You") expressly acknowledge and agree to be bound by these comprehensive Terms of Service (TOS). These terms constitute a legally binding agreement between you and Workspace Global. Your use of the Service is conditioned upon your acceptance of and compliance with these Terms. If you disagree with any part of the terms, you must not access or use the Service. These terms apply to all visitors, users, and others who access or use the Service, including the use of any final or rejected creative assets.

 

Detailed Description of Service and Scope of Work
Workspace Global operates a model of providing a managed, on-demand creative team accessible via a flexible, recurring subscription. The Service is designed to handle a continuous stream of creative projects for the Client.
Service Offerings: Services include, but are not limited to, strategic Brand Identity development, professional Graphic Design (e.g., marketing collateral, social graphics), Web/App Development (front-end design and simple integrations), compelling Copywriting (e.g., website copy, blogs), and structured Social Media Content planning and creation.

 

The Workstream Model:

The core of our service is the "Workstream." This refers to the number of concurrent, active tasks that our team will process for you at any given time.


Subscription Tiers:

The specific number of active Workstreams is strictly defined by the Client's chosen subscription plan (Basic, Standard, or Pro). Once a Workstream slot is occupied by a task, no new tasks will be initiated until the current one is completed or explicitly paused by the Client.


Turnaround and Delivery Timelines:

We commit to transparent and predictable delivery schedules. Turnaround times are calculated in business days and begin once a brief is marked as "complete" and ready for production.
 

Simple Tasks:

A fixed 3-day timeline (e.g., basic social media graphics, simple copy edits).
Advanced Tasks: A fixed 5-day timeline (e.g., multi-page marketing flyers, detailed blog posts, complex web revisions).


Complex Tasks:

A fixed 10-day timeline (e.g., full brand identity system development, website landing page creation with custom graphics). Note: These timelines are estimates for initial delivery and do not include time taken for client review, feedback, or revisions.


Subscriptions, Billing, and Financial Policies

This section outlines the financial relationship and terms related to payment, cancellation, and refunds.
Billing Cycle and Payment: Subscriptions are automatically billed on a monthly recurring basis from the date of the initial sign-up. The Client authorizes Workspace Global to charge the applicable subscription fees to the payment method provided. Failure to process payment will result in immediate suspension of all active Workstreams and access to the Service until the outstanding balance is settled.


Subscription Management and Cancellations:

Clients retain full control over their subscription status. You may pause or cancel your subscription at any time directly through the dedicated Client dashboard.
 

Effect of Cancellation:

A cancellation request takes effect only at the end of the current, pre-paid billing cycle. The Client will continue to receive the Service and utilize any active Workstreams until the last day of the paid period.
Strict No-Refund Policy: Workspace Global operates a strict no-refund policy for all subscription fees paid. By subscribing, the Client acknowledges and agrees that no refunds, partial or full, will be issued under any circumstances, including but not limited to, the Client's inability to fully utilize the Service, changes in the Client's business needs, or dissatisfaction with work-in-progress. This policy is a core aspect of our managed service model, as costs are incurred immediately upon the subscription being active.


Intellectual Property Rights (IP)
Clarity on the ownership of creative work is paramount.
Client Ownership and Transfer of Rights: Upon the successful completion of a project, and the full and final receipt of all associated subscription payments, Workspace Global explicitly transfers all ownership rights, title, and interest of the approved and selected final work (both design and writing) to the Client. This transfer includes the provision of all corresponding editable source files. The Client is then free to use the final work in any manner they deem fit.


Company Rights and Portfolio Use:
Workspace Global explicitly reserves the right to reuse, recycle, or repurpose any creative concepts, initial drafts, or specific pieces of work that were explicitly rejected, unapproved, or not selected by the Client for final use.
Workspace Global also reserves the right to display the completed, approved final work in our online or physical portfolio, case studies, and marketing materials for promotional purposes. This right to display is waived only if a formal, mutually executed Non-Disclosure Agreement (NDA) is in place, explicitly restricting portfolio use.

Client Responsibilities and Cooperation
The efficiency of the Service is highly dependent on timely Client input and cooperation.
Clear and Detailed Briefs: Clients must provide all task instructions, necessary brand assets, and content via clear, complete, and detailed briefs submitted exclusively through the Workspace Global dashboard.
Timely Feedback and Revisions: The Client is responsible for providing timely, constructive feedback for revisions. The revision process will only commence once feedback is officially logged in the dashboard.
Delays: Workspace Global holds no responsibility for any delays in project delivery, turnaround times, or Workstream progression caused directly or indirectly by: (a) insufficient or incomplete information in the initial brief, (b) prolonged lack of client response, or (c) slow approval processes from the Client's side.

Limitation of Liability and Indemnification
Limitation of Damages:

To the maximum extent permitted by applicable law, Workspace Global and its suppliers shall not be liable for any indirect, incidental, special, punitive, or consequential damages whatsoever, including but not limited to, damages for loss of profits, data, or other intangible losses, resulting from: (i) the use or inability to use the Service; (ii) the cost of procurement of substitute goods and services; (iii) unauthorized access to or alteration of your transmissions or data; or (iv) any matter relating to the creative assets or the Service.
 

Maximum Liability:

In no event shall Workspace Global’s total cumulative liability to the Client exceed the total amount paid by the Client to Workspace Global for the Service in the twelve (12) months preceding the claim.
